Trump’s Legal Team Just Dealt Death Blow To Jack Smith

The legal representatives of former President Donald Trump are requesting the judge, who was appointed by President Obama, to hold special counsel Jack Smith in contempt of court. This request is based on Smith’s failure to comply with a stay order that temporarily halted the trial until the appeals court can review the president’s claim of immunity.

U.S. District Court Judge Tanya Chutkan granted a stay on December 13th, 2023, in the federal government’s prosecution of President Trump. The prosecution accuses him of contributing to the bloodshed on J6 through his words and deeds. The U.S. Supreme Court has rejected Smith’s plea to accelerate the examination of the president’s assertion of immunity from prosecution, and has referred the matter back to the District of Columbia Circuit Court for further assessment.

In their legal submission, attorneys representing President Trump requested Judge Chutkan to find Smith in contempt of court for persistently submitting numerous pages of evidence, even after the stay was imposed. This conduct is perceived as Smith effectively functioning as an extension of the Biden Campaign.

“In this manner, the prosecutors seek to weaponize the Stay to spread political propaganda, knowing that President Trump would not fully respond because the Court relieved him of the burdens of litigation during the Stay,” they wrote in a filing obtained by The Daily Caller. “Worse, the prosecutors have announced their intention to continue this partisan-driven misconduct indefinitely, effectively converting this Court’s docket into an arm of the Biden Campaign.”

In addition to the contempt charge, Trump’s legal team demanded “monetary sanctions in the amount of President Trump’s reasonable attorneys’ fees and expenses incurred in responding to the prosecutors’ improper productions.”

During the period of December 17th and 18th, prosecutors presented more than 4,000 pages of “additional discovery” and “exhibit lists”. The president’s lawyers claim that this was done with the intention of causing political harm to him before the GOP presidential primaries in Iowa and New Hampshire.

“Unstated, but obvious, is the prosecutors’ desperate effort to harass President Trump and prevent his likely victory in the 2024 Presidential Election,” Trump’s lawyers wrote Thursday.

The D.C. court is anticipated to consider arguments about the issue of immunity on January 9th. Smith’s team contends that Trump’s claim is a deliberate diversion aimed at prolonging the trial beyond its scheduled date of March 4th. This suggests that the Biden-appointed Justice Department official is determined to prosecute Trump before he has a chance to potentially win the 2024 election and subsequently request the dismissal of the case while serving as the 47th president.

Smith has encountered several obstacles in the case, such as the withdrawal of crucial subpoenas, attempting to incarcerate Trump, attempting to conceal evidence over a distance of more than 1,000 miles from the court, and expending millions of dollars in taxpayer funds to confront the former president’s formidable legal team. Several court observers speculate that a significant portion of his case may be dismissed.
